By accessing and using FuneralBot ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

FuneralBot is an AI-powered chatbot service for funeral homes, provided by James H Cole Home for Funerals. These Terms and Conditions ("Terms") govern your use of our Service.

2. Service Description

FuneralBot provides:

• AI-powered chatbot for automated customer service
• 24/7 online chat handling and inquiry management
• Consultation scheduling automation
• Go High Level account access with automation workflows
• Website integration and setup support
• Ongoing customer support

3. Subscription and Payment

3.1 Subscription Plans

FuneralBot offers two subscription plans:

• Monthly Plan: $500 per month, billed monthly
• Annual Plan: $5,000 per year, billed annually (saves $1,000)

3.2 Payment Terms

• All fees are due in advance of the subscription period
• Payments are processed securely through third-party payment processors
• You authorize us to charge your payment method for all fees
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days' notice

3.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings or by contacting us.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

5. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service to send spam or unsolicited communications

6. Intellectual Property

The Service and its original content, features, and functionality are owned by FuneralBot and James H Cole Home for Funerals and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

7. Service Availability

We strive to provide reliable service but do not guarantee that the Service will be available 100% of the time. The Service may be unavailable due to:

• Scheduled maintenance
• Unforeseen technical issues
• Third-party service outages
• Force majeure events

We will make reasonable efforts to minimize downtime and provide advance notice of scheduled maintenance when possible.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNERALBOT AND JAMES H COLE HOME FOR FUNERALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless FuneralBot, James H Cole Home for Funerals, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time, and your access will continue until the end of your current billing period.

11. Third-Party Services

FuneralBot integrates with third-party services, including:

• Go High Level: Your subscription includes access to Go High Level platform, subject to their terms of service
• Payment Processors: Payment processing is handled by third-party providers
• Hosting Services: Our Service may be hosted on third-party infrastructure

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their respective terms and conditions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of the United States.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
